Terms of Service

These Terms of Service ("Terms") govern your use of the OPTMZ app ("OPTMZ," "we," "us," "our"). By creating an account or using the App, you agree to these Terms.

1. The Service

OPTMZ is a gamified life-tracking application combining habit tracking, fitness and nutrition logging, AI-powered features, and social and challenge features (including "OPTMZ30" and similar events).

2. Eligibility

You must be at least 16 years old to use OPTMZ (or the minimum digital consent age in your jurisdiction, if higher). By using the App, you represent that you meet this requirement.

3. Accounts

You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately of any unauthorised use.

4. Subscriptions and Payments

• Subscriptions (weekly, monthly, or yearly) are billed through the Apple App Store or Google Play Store and are subject to their respective terms.
• Prices may vary by region and may be discounted for users with a valid creator or referral code, as displayed at time of purchase.
• Apple App Store or Google Play subscription trials may automatically convert into paid subscriptions unless cancelled before the trial ends, as displayed at purchase. OPTMZ may also provide a separate no-card preview that expires without automatically starting a paid subscription.
• Deleting your OPTMZ account does not automatically cancel an active Apple or Google subscription. Manage that separately through your Apple or Google account settings.
• Refunds are handled by Apple and Google per their standard policies; we do not directly process refunds.

5. User Content

You retain ownership of content you submit (photos, logs, messages). By submitting content, you grant us a licence to store, process, and display it as needed to operate the App (e.g. displaying your "Memory of the Day" posts to friends or the global feed if you choose to share them).

You are solely responsible for content you post publicly (e.g. OPTMZ30 proof photos) and must not post content that is illegal, infringing, or violates others' rights.

6. AI Features

OPTMZ uses third-party AI services (see our Privacy Policy for details) to power food-photo analysis and the AI Coach. AI-generated responses are provided for informational and motivational purposes only and are not medical, nutritional, or fitness professional advice. Consult a qualified professional before making health decisions based on anything OPTMZ or its AI Coach suggests.

7. Challenges and Cash Prizes (e.g. OPTMZ30)

Participation in challenges with cash-prize components (such as OPTMZ30) is subject to separate published rules for that challenge, including eligibility, prize structure, and payout timing. Employees, founders, and team members of OPTMZ are not eligible for cash prizes. We reserve the right to disqualify participants for fraudulent activity (e.g. fake proof submissions, self-referral abuse).

8. Creator and Referral Program

If you participate as a creator or referral partner, commission terms (rates, caps, payout timing and minimums) are as separately communicated to you and may be updated with notice. Commissions are not earned for downloads, non-converting trials, refunds, chargebacks, or fraudulent accounts.

9. Prohibited Conduct

You agree not to:

• Attempt to manipulate XP, streaks, leaderboard rankings, or referral attribution through exploits, automation, or fraudulent accounts
• Reverse-engineer, scrape, or interfere with the App's operation
• Use the App for any unlawful purpose

10. Termination

We may suspend or terminate your account for violation of these Terms. You may delete your account at any time via Settings.

11. Disclaimer of Warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not guarantee the App will be uninterrupted, error-free, or that any specific fitness, health, or financial (e.g. commission) outcome will result from use of the App.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• OPTMZ and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising from your use of (or inability to use) the App.
• Our total aggregate liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the total amount you paid to us for subscription services in the twelve (12) months immediately preceding the event giving rise to the claim. If you have not paid us anything in that period, our aggregate liability shall not exceed £20.
• This limitation applies regardless of the legal theory of liability (contract, tort, negligence, or otherwise) and even if we have been advised of the possibility of such damages.
• Nothing in these Terms limits liability that cannot be limited under applicable law (e.g. liability for death, personal injury caused by negligence, or fraud).

13. Indemnification

You agree to indemnify and hold OPTMZ harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the App.

14. Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. If you are a consumer, you may also benefit from mandatory protections provided by the laws of the country in which you normally reside.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
